Once a valid and complete infringement notice is received, Akiooue will review it promptly and take appropriate action, which may include removing or disabling access to the allegedly infringing content.
B. Counter-Notice Procedure
If you believe that content was removed or disabled as a result of a mistake or misidentification, you may send a counter-notice to the same contact email listed above.
Your counter-notice must include:
- Identification of the material that has been removed or disabled, including the location (URL) where it appeared before removal.
- A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled due to a mistake or misidentification.
- Your contact information: full name, mailing address, phone number, and email.
- A statement that you consent to the jurisdiction of the Federal District Court for the district where you reside (or, if outside the U.S., to an appropriate judicial authority).
- Your electronic or physical signature.
If a valid counter-notice is received, we may send a copy to the original complainant.
Unless the complainant files a court action within 10β14 business days, we may, at our discretion, restore access to the removed material.
C. Important Legal Notice (DMCA Section 512(f))
Under Section 512(f) of the U.S. Digital Millennium Copyright Act (DMCA), any person who knowingly makes a false claim or misrepresents infringement may be held liable for damages, including attorneyβs fees and costs.
